In recent years, cannabis products have surged in popularity, with customers seeking alternative wellness solutions.

As the market evolves, so does the legal status of various cannabis compounds. Here, we’ll explore the legal intricacies surrounding cannabis, shedding light on why products containing certain compounds are federally legal and can be shipped to most states in the US.

Mood’s legal status explained: A letter from attorney Rod Kight

First, what type of THC does Mood use?

The majority of our flowers and vape cartridgesuse hemp-derived THCa (tetrahydrocannabinolic acid), a non-psychoactive compound found in cannabis. In its natural state, it doesn’t produce the intoxicating effects commonly associated with THC (tetrahydrocannabinol). Only when heated (like when you spark a joint) does THCa convert into THC, a process known as decarboxylation, which produces a “high.”

Our other products, such as edibles and concentrates that aren’t heated during use, typically feature hemp-derived Delta-8 THC and/or Delta-9 THC, which are close relatives of THCa. Both are psychoactive compounds, but they differ in their molecular structures, resulting in varied effects and potencies. Both cannabinoids are found in marijuana and hemp.

Are products made with THCa, Delta-8 THC, and Delta-9 THC federally legal?

Yes! The legal foundation for the cultivation and sale of hemp-derived products, including those like ours featuring THCa, Delta-8 THC, and Delta-9 THC, can be traced back to the Agriculture Improvement Act of 2018, commonly known as the Farm Bill. This landmark legislation removed hemp—defined as cannabis with less than 0.3% Delta 9 THC by dry weight—from the list of controlled substances, officially distinguishing it from marijuana.

Products which adhere to Farm Bill criteria are legally permitted to be shipped to most states in the US. In addition to THC content limitations, there are strict regulations on hemp cultivation, ensuring that it is conducted by licensed growers in accordance with state, tribal, or federal law—and manufacturers like Mood must rigorously test and monitor cannabis products to ensure regulatory compliance.

Where does Mood cannabis come from?

All Mood cannabis is sourced from small-scale US hemp farms run by growers who don’t use pesticides and who collectively have decades of experience cultivating the plants. Growing consistently high-quality hemp requires skill, science, patience, and a whole lot of love. Our growers have proprietary varieties they’ve spent years developing, and you can see, smell, taste, and feel the difference between the cannabis from Mood’s growers and the cheap stuff flooding the modern market. How do federal and state laws differ?

It's crucial to note that while hemp-derived products are federally legal, state laws vary. Some states may have more permissive regulations, while others may impose additional restrictions or outright bans on certain cannabis-derived products.

Is it lawful to travel with cannabis products in the US?

The legality of traveling with cannabis products depends on state-by-state regulations. It’s essential you research and understand the specific laws of your destination and any states through which you may be traveling before packing your favorite sidekick. As general rules:

✦ Traveling with cannabis products derived from hemp with 0.3% Delta-9 THC by dry weight or less is usually allowed if they comply with both federal and state laws.

✦ Traveling with any cannabis product containing THC exceeding 0.3% Delta-9 THC by dry weight is illegal federally, regardless of state legalization. Medicinal cannabis with legal documentation in complying states might be a very rare exception, but be sure to do your homework before taking the risk.

In a rapidly evolving legal landscape, navigating the complexities of cannabis regulations can be perplexing—and it’s essential to recognize that the legal status of cannabis compounds is subject to change. Mood remains committed to staying on top of evolving laws, and we work closely with experts to ensure our products meet all regulatory requirements, providing our customers with high-quality, federally legal cannabis.
