Legally speaking and in the eyes of the 2018 Farm Bill and the DEA, the differentiating factor between marijuana, which is a Schedule I controlled substance, and hemp, a federally legal plant, is the Delta-9 THC content of the plant or product. If a product or plant contains more than 0.3% Delta-9 THC on a dry weight basis, it is marijuana and federally illegal under the Controlled Substances Act.
